Acceptance of Terms

By accessing or using the American Bully Kennel Club (ABKC) website, mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and the American Bully Kennel Club. Your continued use of the Services following the posting of any changes to these Terms constitutes acceptance of those changes. We encourage you to review these Terms periodically.

User Accounts

To access certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You must be at least 18 years of age to create an account. Parents or legal guardians may create accounts on behalf of minors for participation in ABKC Junior Handler programs, subject to our Privacy Policy and COPPA requirements. ABKC reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in conduct detrimental to the ABKC community.

Dog Registration

ABKC provides official breed registration services for the American Bully and associated bully breeds. By submitting a dog for registration, you represent and warrant that you are the rightful owner of the dog or have been authorized by the owner to submit the registration. All information provided, including pedigree documentation, DNA test results, and photographs, must be truthful and accurate. Submission of fraudulent pedigree information, falsified DNA results, or misrepresented photographs is strictly prohibited and may result in permanent revocation of registration privileges, forfeiture of all titles and points earned by the dog, and legal action. Registration fees are non-refundable once the application has been processed. Ownership transfers require digital signatures from both the seller and buyer and are subject to a transfer fee.

Show Entry

ABKC-sanctioned shows are governed by the official ABKC show rules and regulations, which are incorporated into these Terms by reference. By entering a dog in an ABKC-sanctioned show, you agree to abide by all applicable show rules, the decisions of ABKC-certified judges, and the authority of show officials. Show entry fees are non-refundable after the close of pre-registration for that event. Early withdrawal or failure to appear does not entitle you to a refund of entry fees. ABKC reserves the right to disqualify any entry that violates show rules, exhibits unsportsmanlike conduct, or presents a safety concern. Dogs must be current on vaccinations as required by the host venue's jurisdiction. ABKC is not responsible for injury, illness, or loss of any dog at a sanctioned event, though we require all show hosts to maintain adequate liability insurance.

Commerce and Refunds

ABKC offers merchandise for purchase through our online shop. All prices are listed in US Dollars and are subject to change without notice. Payment is processed securely through Stripe. For physical merchandise (apparel, accessories, stickers, and other tangible goods), you may request a full refund within 14 days of delivery, provided the item is unused, unwashed, and in its original packaging. To initiate a return, contact shop@abkcdogs.net with your order number. Shipping costs for returns are the responsibility of the buyer unless the item was defective or incorrectly shipped. Digital products, show entry fees, and dog registration fees are non-refundable. ABKC is not responsible for items lost or damaged during shipping, though we will work with our shipping partners to resolve any issues.

Intellectual Property

All content on the ABKC website, including but not limited to text, graphics, logos, images, breed standards, show results, the ABKC name, and the ABKC logo, is the property of the American Bully Kennel Club or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The ABKC name, logo, and all related marks are registered trademarks of the American Bully Kennel Club. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any ABKC content without prior written permission, except for personal, non-commercial use such as printing show results for your own records.

Limitation of Liability

To the maximum extent permitted by applicable law, ABKC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Services. ABKC's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to ABKC in the twelve months preceding the claim. ABKC does not guarantee the accuracy of pedigree information submitted by third parties, nor do we guarantee specific outcomes at any sanctioned show or event.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Santa Clara County, California. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts. Notwithstanding the foregoing, ABKC may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Changes to These Terms

ABKC reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered users and posted prominently on our website at least 30 days before taking effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Services and may request account deletion by contacting us at support@abkcdogs.net.
